DISABLED VETERANS’ EXEMPTION

Real Estate

Effective January 1, 2011, the Commonwealth of Virginia imposed a new law allowing an exemption on real estate for qualified disabled veterans and their spouses.

To qualify the disabled veterans has to:
1) Have a service-connected disability 
2) Have a 100% “permanent and total” rating or be unemployable and paid at the 100% rate
3) Reside in the dwelling that’s your primary residence 
4) The surviving spouse of the veteran can also qualify as long as the veteran died after January 1, 2011; an updated application will need to be provided.  

To apply:
1) An application can be obtained from the commissioner’s office.
(forms are color coded for office use)
2) Provide your summary of benefits letter.
3) Provide proof of residency; such as a driver’s license or electric bill.
4) Provide proof of ownership; deed, will, marriage license, etc.

Applications can be submitted at any time.

What is exempt?
1) One acre of land
2) Primary dwelling  (house or manufactured home) that is the principal place of residency
3) Other improvements which are situated on the one acre which is used to house and cover motor vehicle or household goods and other personal effects

DISABLED VETERAN EXEMPTION

Personal Property

Effective January 1, 2021, and pursuant to Virginia Code subdivision (a) (8) Article X, Section 6 of the Constitution of Virginia, one motor vehicle owned and used primarily by or for a veteran of the Armed Forces of the United State or the Virginia National Guard who has been rated by the U.S. Department of Veterans Affairs or its successor agency pursuant to federal law with a 100 percent service-connected, permanent and total disability shall be exempt from taxation.

To apply:
1) An application can be obtained from the commissioner’s office
 (forms are color coded for office use)
2) Provide your summary of benefits letter

Note:
• Please make sure that the vehicle to be exempt was owned January 1st, when filling out the form.  
• Re-apply only if the personal property changes.  Another form will need to be submitted.  
• The vehicle has to be an automobile or pickup in order to qualify.
• It has to be your personal vehicle. It cannot be a vehicle that is used for business.
